This User Agreement is a binding arrangement between you and the developer of MaskAI regarding your use of the MaskAI application—a convenient image fusion tool dedicated to providing efficient mask try-on services. By downloading, installing, or using the App, you confirm that you have read, understood, and agree to comply with all terms and conditions outlined in this Agreement. If you do not agree to these terms, please uninstall the App immediately and cease all use.
The App operates entirely without requiring user accounts or login credentials, allowing you to access all its functions anonymously. A core principle of the App is that all data processing, including image uploads, facial key point recognition, mask fusion, and temporary image rendering, occurs exclusively on your local device. We never collect, store, transmit, process, or analyze any user images, facial information, biometric data, or other personal privacy data—including but not limited to facial contours, feature coordinates, skin tones, or any derivative data generated during mask try-on—to external servers, third parties, or our own systems. No such data is synced, backed up, or transferred off your device under any circumstances. We ensure strict protection of your information through localized data processing mechanisms, robust code encryption, and no background data transmission, to prevent any leakage, misuse, unauthorized access, or accidental collection of your personal data. This Agreement governs your anonymous use of the App, including interactions with its mask try-on features, built-in mask resources, custom mask uploads, and related functionalities, all of which adhere to the aforementioned privacy protection principles.
We grant you a non-exclusive, non-transferable, revocable license to use the App on your personal mobile device(s) solely for your own personal, non-commercial purposes. This license allows you to access and utilize the App’s core features, including trying on built-in masks, uploading custom mask images, generating mask try-on effects, and saving or sharing the final results as permitted by this Agreement. This license does not permit you to:
Copy, modify, distribute, reproduce, reverse engineer, decompile, disassemble, or attempt to extract the source code of the App or any part thereof, including built-in mask resources and AI processing modules.
Rent, lease, sublicense, sell, or otherwise transfer the App or your right to use it to any third party, or share access to the App with others in a way that violates the non-commercial, personal use restriction.
Use the App for any illegal, unauthorized, or fraudulent activity, including but not limited to creating or sharing mask try-on images that infringe on third-party rights, contain inappropriate content, or violate local, national, or international regulations.
Manipulate, bypass, or attempt to circumvent the App’s functional restrictions, including using modified versions of the App, plug-ins, or other tools to interfere with local data processing, access hidden features, or alter the mask try-on functionality—such acts may compromise the core mechanism of local data security and non-collection of facial information, and may expose your personal data to unnecessary risks.
Use the App in a way that damages, disables, overburdens, or impairs the App’s local functionality, or disrupts the normal operation of your device during data processing.
The App provides intelligent mask try-on services through local AI technology, with a strict commitment to privacy protection embedded in every functional link. It includes a rich built-in mask resource library covering various scenarios and styles, and supports you to upload custom mask images for personalized try-on. When you upload a personal photo, the App automatically identifies facial key points locally on your device—this entire process is completed in real time within your device’s local environment, with no data transmission to external servers, cloud storage, or any third-party platforms. Importantly, no facial feature data, including temporary recognition results, coordinate data, or processed image fragments, is retained, collected, stored, or reused after the mask try-on process is completed. The AI algorithm only performs real-time computing on your device to achieve precise fitting of masks to faces, generating realistic and natural try-on effects, and all intermediate data is immediately discarded once the process ends.
We strive to ensure the stability, accuracy, and smoothness of the App’s functionality, but we do not guarantee that the mask try-on effects will meet your expectations in all cases. The quality of the effect may be affected by factors such as the clarity of the uploaded photo, lighting conditions, facial angles, and the design of the mask itself. The App’s operation process is designed to be simple and easy to understand, requiring no professional skills, and is suitable for holiday dressing, social sharing, creative creation, and other personal scenarios. Throughout all these scenarios, the non-collection principle of facial and personal data is strictly followed.
We reserve the right to adjust, optimize, or update the App’s functionality, built-in mask resources, and local processing algorithms from time to time to enhance the user experience. Such updates will be provided through your device’s app store, and installing updates is optional (unless the update is mandatory to maintain basic functionality). All updates will strictly adhere to the core principle of local data processing; we will never modify this principle, add functions that involve collecting facial information or personal data, or embed any code that enables data transmission to external parties. Any update will be accompanied by a clear description of changes, and will not alter our commitment to non-collection of user data.
When using the App, you agree to abide by the following rules to ensure a positive and compliant experience for yourself and others, while maintaining the integrity of the App’s privacy protection mechanism:
You will only upload personal photos and custom mask images that you have the legal right to use. You confirm that the content you upload does not infringe on the intellectual property rights, privacy, portrait rights, or other legitimate rights of any third party. You shall be solely responsible for any disputes, claims, or losses arising from the unauthorized use of third-party content in the App.
You will not use the App to process or generate images containing inappropriate, illegal, or offensive content, including but not limited to violent, pornographic, discriminatory, defamatory, hate-related, or harmful content. You will not use the App to create content that violates public order and good customs or is intended to harass, intimidate, or harm others.
You acknowledge that all data processing occurs locally on your device, and you are responsible for maintaining the security of your device to prevent unauthorized access to the App, your uploaded images, and generated mask try-on effects. We are not liable for any loss, leakage, or misuse of data caused by your failure to secure your device, share your device with others, or use unsafe device settings—including the leakage of facial images stored locally on your device. Please note that we have no access to or control over data stored on your device, and thus cannot be held responsible for data breaches caused by device security vulnerabilities or improper use by you.
You will use the App strictly for personal, non-commercial purposes. You shall not use the App to provide paid mask try-on services to third parties, resell or distribute generated images for commercial gain, or integrate the App’s functionality into any commercial workflow without our explicit written permission.
You will not overload the App’s local processing capabilities by uploading an excessive number of images in a short period, or by uploading images with abnormal sizes or formats that may cause the App to crash or malfunction.
Your privacy is a top priority, and our data practices are fully consistent with the MaskAI Privacy Policy, with a strict "zero-collection" principle for all facial and personal data. By using the App, you acknowledge and agree to the following key points regarding data handling, which further clarify our non-collection commitment:
No data collection: We do not collect, store, transmit, process, analyze, or retain any of your uploaded personal photos, custom mask images, facial key points, biometric information, or other personal privacy data—including but not limited to facial feature data, image metadata, usage logs related to mask try-on, or any other data that can identify you or your facial characteristics—to external servers, cloud services, or any third parties. All data processing, including AI recognition, mask fusion, and image rendering, is completed entirely within your local device. No intermediate data, temporary files, or final results (unless you actively save them to your device’s local storage) are shared with us or any third parties. We do not install any tracking tools, data collection modules, or analytics software that can capture facial information or personal data. The "zero-collection" principle applies to all usage scenarios, including app updates, technical support, and functional adjustments.
Local storage control: Temporary data generated during use (such as uploaded images not saved to your device, intermediate recognition results, or unprocessed image fragments) is stored in the App’s local cache only for the duration of your usage session. This temporary data is automatically cleared immediately when you close the App, exit the mask try-on interface, or empty the cache manually. Final mask try-on images you choose to save are stored exclusively in your device’s local storage, and you have full, exclusive control over saving, sharing, deleting, or managing these images—including any images containing facial information. We have no access to, control over, or ability to retrieve any data stored in your device’s local storage.
Information protection: We implement robust security measures to protect local data processing, including data isolation, secure coding practices, no background data transmission, and local algorithm encryption. The App does not request or obtain any unnecessary device permissions that may be used to access facial data or personal information. However, you are solely responsible for securing your device to prevent unauthorized access to your App data, including facial images and personal content stored locally. This includes setting strong device passwords, avoiding sharing your device with others, and keeping your device’s operating system and security software up to date.
We will never sell, rent, lease, disclose, or otherwise monetize any of your data to third parties, and since we do not collect any data in the first place, there is no information to share, transfer, or profit from under any circumstances. This commitment is unwavering and applies to all present and future versions of the App, ensuring the maximum protection of your facial information and privacy security.
All intellectual property rights in and to the App, including but not limited to software code, algorithms, built-in mask resources, logos, trademarks, text, graphics, user interfaces, and proprietary technologies, are owned by us or our licensors. This Agreement does not transfer any intellectual property rights to you, and you shall not claim any ownership interest in the App or its content.
Built-in mask resources: All built-in mask images and resources provided in the App are protected by copyright and other intellectual property laws. You are granted a limited license to use these resources solely for personal, non-commercial mask try-on within the App. You shall not extract, reproduce, distribute, or modify built-in mask resources for use outside the App without our explicit written permission.
User-generated content: Final mask try-on images you generate using the App are your property, and you have the right to save, share, or use them for personal purposes. However, you shall ensure that such content does not infringe on third-party rights, and we are not liable for any use of your user-generated content beyond the App. Please note that when you share such content through third-party platforms, the data transmission and privacy practices of those platforms are beyond our control, and you should review their privacy policies before sharing.
Custom mask images: If you upload custom mask images that you do not own the rights to, you shall be solely responsible for any intellectual property infringement claims. We do not review or verify the ownership of custom mask images, and we are not liable for disputes arising from their use.
You may not use our trademarks, logos, or other intellectual property in any way that implies endorsement, partnership, or affiliation without our prior written permission.
The App is provided "as is" and "as available" without any warranties of any kind. We disclaim all implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be error-free, uninterrupted, or compatible with all device models, or that the mask try-on effects will be accurate, realistic, or suitable for all use cases.
We are not liable for any damage or loss caused by your use of the App, including but not limited to device malfunctions, data loss (resulting from device issues), disputes arising from user-generated content, or losses caused by reliance on mask try-on effects. We are also not liable for any issues caused by factors beyond our reasonable control, including but not limited to device hardware failures, operating system updates, or user error in using the App.
The App’s local processing functionality may be affected by your device’s performance, storage capacity, and software version. We recommend using the App on devices that meet the minimum system requirements to ensure optimal performance. Special note: We do not guarantee or warrant that locally stored data (including facial images) will be protected against device theft, hacking, or unauthorized access by third parties—such risks shall be borne solely by you. As we do not collect or store any of your data, we cannot assist in recovering lost data or mitigating damages caused by local data breaches.
We may release updates to the App from time to time to fix bugs, enhance security, optimize local processing algorithms, add new built-in mask resources, or improve functionality. These updates may be available through your device’s app store, and you can choose to install or decline them (except for mandatory security updates that are necessary to maintain the App’s basic functionality). All updates will be designed to maintain the core principle of local data processing and non-collection of facial information; no update will introduce data collection features without clear, advance notification and your explicit consent.
We reserve the right to modify this Agreement at any time. When we make changes, we will revise the "Last Updated" date at the bottom of this Agreement and notify you within the App (via a pop-up notification) the next time you use it. The updated Agreement will take effect immediately upon notification, and your continued use of the App after the update constitutes your acceptance of the modified terms. If you do not agree to the changes, please uninstall the App and cease use. Any modifications to this Agreement will not weaken our core commitment to not collecting facial information and personal privacy data; on the contrary, such commitments may be further strengthened to align with evolving privacy protection standards.
This Agreement shall remain in effect for as long as you use the App. You may terminate this Agreement at any time by uninstalling the App and deleting all App-related temporary data from your device. Uninstalling the App will not affect any user-generated images you have saved to your device’s local storage, and we will not retain any of your data after uninstallation—consistent with our non-collection principle.
We reserve the right to terminate or suspend your access to the App at our discretion, without prior notice, if you violate any terms of this Agreement. Examples of violations include unauthorized commercial use, infringement of intellectual property rights, uploading inappropriate content, or using modified versions of the App. Upon termination, you must cease all use of the App and uninstall it from your device. The sections regarding intellectual property rights, disclaimers, and general provisions shall survive termination of this Agreement. Importantly, termination will not result in our collection, transmission, or disclosure of any remaining local data on your device, including facial images and privacy content—we have no ability or right to access such data at any time, including after termination.
This Agreement, together with the MaskAI Privacy Policy, constitutes the entire agreement between you and us regarding your use of the App, superseding all prior or contemporaneous agreements, understandings, or communications (whether oral or written). Both documents emphasize our unwavering commitment to non-collection of facial information and personal data, and any inconsistency between them shall be resolved in a manner that prioritizes your privacy protection.
The App minimizes integration with third-party services to protect your privacy. The only third-party interaction occurs when you choose to share user-generated images via external apps (such as social media, messaging apps, or email)—this sharing is initiated and controlled entirely by you, and we have no access to or control over the data transmitted during these actions, nor do we collect any data related to such sharing activities. We are not liable for any issues arising from third-party sharing services, including the transmission of facial images through such services, as these actions are beyond our control and governed by the privacy policies of the respective third parties.
