This Subscription Agreement is entered into between you and the developer of MaskAI and governs your use of the premium subscription services offered within the MaskAI application —a convenient image fusion tool dedicated to providing efficient mask try-on services. By purchasing, activating, or using the Premium Services, you confirm that you have read, understood, and agree to comply with all terms and conditions outlined in this Agreement, as well as the MaskAI User Agreement and Privacy Policy. If you do not agree to these terms, please refrain from purchasing or using the Premium Services.
The App operates entirely without requiring user accounts or login credentials, and your Premium Services access is tied exclusively to the mobile device(s) you use to complete the purchase. A core principle of both the App and Premium Services is that all data processing—including image uploads, facial key point recognition, mask fusion, storage of premium-related data, customization settings, and batch processing history—occurs solely on your local device, with zero collection of facial information, biometric data, or any other personal privacy data. We will never collect, store, transmit, process, or analyze any user images, facial features, biometric information, personal data, or any derivative data generated during the use of Premium Services to external servers, third parties, or our own systems. No such data is synced, backed up, or transferred off your device under any circumstances. We strictly safeguard your information security and privacy rights through localized data processing mechanisms, robust code encryption, and no background data transmission, to prevent any leakage, misuse, unauthorized access, or accidental collection of your data. This Agreement clarifies the rights and obligations associated with your Premium Services subscription, including pricing, duration, renewal, cancellation, and access to exclusive premium features, all of which adhere to the aforementioned privacy protection principles.
The Premium Services enhance the core mask try-on functionality of MaskAI by unlocking exclusive features not available in the free version of the App. These features are designed to elevate your creative experience while maintaining the same strict local data processing standards and privacy protection commitments—no facial information, biometric data, personal data, or any data that can identify you or your facial characteristics will be collected, stored, transmitted, or processed at any stage of using the Premium Services. The specific Premium Services include, but are not limited to:
Advanced mask customization tools, such as adjustable transparency, edge blending, color tuning, and facial feature alignment, allowing you to refine mask try-on effects for more realistic and personalized results. All adjustments are processed in real time exclusively on your local device, with no facial data, feature coordinates, or processed image fragments collected, stored, or transmitted to any external party. The AI algorithm only performs temporary local computing to optimize effects, and all intermediate data is immediately discarded upon completion of each customization.
Unlimited generation of mask try-on photos, enabling you to create and preview an unlimited number of mask-overlaid images with no caps on quantity. All generation processes are completed locally on your device, with no facial information, personal data, image metadata, or usage logs related to the generation process collected, stored, or transmitted. Even temporary preview files are stored only in the App’s local cache and automatically cleared when you exit the generation interface or close the App.
Priority technical support, with expedited responses (within 2 business days) to inquiries, issues, or feedback related to Premium Services, mask try-on functionality, or local data management. Support communications will not involve collecting your facial data, biometric information, personal data, or any details about your locally processed content. We will never request you to share images, customization settings, or any data containing facial features when assisting with technical issues.
We reserve the right to modify, add, or remove Premium Services features from time to time to enhance the user experience, provided that such changes do not materially reduce the overall value of the subscription during your active billing period and will not alter our commitment to non-collection of facial information and personal privacy data. All feature updates will be designed to maintain strict local data processing, with no embedded code that enables data collection or transmission. We will notify you of significant feature adjustments via in-app pop-up notification, and all updates to Premium Services will maintain the core principle of local data processing without any data collection.
We offer three subscription plans for the Premium Services: monthly, half-yearly, and annual plans (collectively, "Plans"). The specific details of each Plan—including exact pricing, duration, and full feature access—are displayed clearly within the App’s subscription page at the time of purchase. Pricing is subject to change for new subscriptions, but any price adjustments will not affect active subscriptions until the next renewal period. A half-yearly Plan refers to a 6-month subscription cycle, with a duration of approximately 180-184 days depending on the months included in the billing period; annual Plans run for 365 days, and monthly Plans for approximately 30 days per cycle. All plan-related information is processed and displayed locally on your device, with no data about your plan selection or usage habits collected by us.
By selecting a Plan, you agree to pay the applicable subscription fee using the payment method linked to your device’s app store account (e.g., Apple App Store, Google Play Store). All fees are charged in the currency displayed at the time of purchase, and you are solely responsible for any additional taxes, fees, or currency conversion charges imposed by your payment provider or local authorities.
Payment is processed immediately upon subscription activation for the first billing period. For all Plans (monthly, half-yearly, annual), payment will be automatically charged to your designated payment method at the start of each renewal period, unless you cancel the subscription before the renewal date (as outlined in Section 4). The exact renewal date and upcoming charge amount will be displayed in the App’s subscription management section for your reference.
We do not store your payment information directly—all payment processing is handled exclusively by your device’s app store provider, which adheres to industry-standard privacy and security practices to protect your payment details. You acknowledge that we have no control over app store payment processes, including failed charges, payment method updates, or refund processing for payment-related issues, and you agree to direct such inquiries to your app store provider. At no point will we collect or process your payment information, facial data, biometric information, personal data, or any data related to your payment transactions or subscription usage. We do not install any tracking tools or analytics modules to capture data about your payment behavior or subscription status.
Your Premium Services subscription begins immediately upon successful payment, and access to all premium features is activated instantly on the purchasing device. The subscription remains active for the duration specified in your selected Plan: approximately 30 days for monthly, 180-184 days for half-yearly, and 365 days for annual plans. The exact end date of your subscription, as well as the renewal date, will be clearly displayed in the App’s subscription settings for easy reference, with all date calculations and status updates processed locally on your device.
Premium Services access is tied to the device used for purchase. For multi-device access (if supported), you may link additional devices to your subscription through the App’s settings, provided that all linked devices are owned and used exclusively by you. You may not share your Premium Services access with any third parties, including family members, friends, or colleagues, and any unauthorized sharing, transfer, or misuse of access rights may result in immediate termination of your subscription without refund. Multi-device access setup will not involve collecting, syncing, or transmitting your facial information, personal data, customization settings, or any locally processed content across devices—all data remains exclusively stored on each individual device, with no cross-device data transfer of any kind.
If you uninstall the App or switch to a new device, your Premium Services access can be restored by logging into the same app store account used for purchase and reinstalling the App. We are not responsible for lost access to Premium Services due to app store account issues, device theft, accidental uninstallation, failure to link devices correctly, or device hardware/software failures. Premium features will only be accessible on devices where the App is installed and linked to the purchasing app store account. Restoring access will not require you to provide any facial information, biometric data, personal data, or locally processed content, and no such data will be collected, requested, or transmitted during the restoration process.
All Premium Services subscriptions (monthly, half-yearly, annual) are set to automatically renew at the end of each billing period, unless you explicitly cancel the subscription before the renewal date. In compliance with app store policies, the app store will notify you of the upcoming renewal and the applicable fee at least 24 hours before the renewal is processed. You can view your renewal date, manage auto-renewal settings, and cancel your subscription at any time through your device’s app store account settings or the App’s built-in subscription management section. All renewal management actions are processed locally on your device, with no data about your renewal preferences or cancellation behavior collected by us.
You may cancel your subscription at any time, and cancellation takes effect immediately. However, you will retain full access to Premium Services until the end of your current billing period. No refunds or prorated credits are provided for partial billing periods, unused Premium Services, or cancellation after the renewal has been processed. For example, if you cancel a monthly subscription halfway through the cycle, you will continue to have access to premium features until the end of that 30-day period, but no refund will be issued for the unused portion.
To avoid being charged for the next renewal period, you must cancel the subscription at least 24 hours before the scheduled renewal date. We are not responsible for failed cancellations due to user error, app store delays, technical issues beyond our control, or failure to follow app store or App-specific cancellation instructions. We recommend verifying cancellation status in your app store account settings after submitting a cancellation request. Cancellation does not trigger any data collection or transmission—all information about your cancelled subscription remains stored locally on your device and will be cleared when you uninstall the App.
We do not offer refunds for Premium Services subscriptions (monthly, half-yearly, annual) except in the following limited circumstances, where we may, at our sole discretion, issue a full or prorated refund:
Duplicate charges for the same subscription period, provided you notify us within 7 days of the duplicate charge and provide valid proof of payment (such as a payment receipt from your app store account). We will not request any facial data, biometric information, personal data, or locally processed content to verify duplicate charges.
Technical issues that prevent access to Premium Services for more than 7 consecutive days, and we are unable to resolve the issue within a reasonable timeframe (typically 3 business days) after you report it. Refunds for such cases will be prorated based on the unused portion of your subscription. When troubleshooting technical issues, we will not request you to share images, facial data, customization settings, or any locally processed content—support will be provided based on general app functionality, not your personal data.
Premature termination of Premium Services by us (excluding termination due to your breach of this Agreement or the Applicable Policies). In such cases, a full refund for the unused portion of your subscription will be issued.
Misrepresentation of Premium Services features, where the actual features do not match the clear description provided on the App’s subscription page at the time of purchase. Refunds for such cases will be issued in full.
Refund requests must be submitted via the contact email provided in Section 11, and we will review and respond to all requests within 5 business days. Approved refunds will be processed through the original payment method, and the timeline for the refund to appear in your account (typically 3-7 business days) depends on your payment provider. We reserve the right to request additional information to verify refund eligibility, but such information will never include facial data, biometric information, unnecessary personal privacy data, or any locally processed content from your device.
In addition to the usage rules outlined in the MaskAI User Agreement, you agree to the following restrictions when using Premium Services, to ensure compliance, protect intellectual property, and maintain service quality:
You will use Premium Services strictly for personal, non-commercial purposes. You shall not use Premium Services to provide paid mask try-on services to third parties, resell or distribute generated images for commercial gain, integrate Premium Services into commercial workflows, or use premium features for any business-related activities without our explicit written permission.
You will not manipulate, bypass, or attempt to circumvent Premium Services access controls, including using modified versions of the App, plug-ins, hacks, or other tools to unlock Premium Services without payment, share access with third parties, or alter the local data processing functionality. Such acts may compromise the non-collection of facial and personal data, expose your local data to security risks, and disrupt the privacy protection mechanisms embedded in the App.
You will not use Premium Services to process or generate images containing inappropriate, illegal, or offensive content—including but not limited to violent, pornographic, discriminatory, defamatory, hate-related, or harmful content—or to violate the intellectual property rights, privacy, portrait rights, or other legitimate rights of third parties. This includes refraining from uploading images of others’ faces without their consent, as we do not collect or verify such consent and will not be liable for related disputes. All content processing is done locally on your device, and we have no ability to access or moderate the content you process.
You will not overload the App’s local processing capabilities by uploading an excessive number of images, using abnormally large or corrupted image files, or engaging in automated or repetitive actions that disrupt the App’s functionality, crash the App, or impair your device’s performance.
You will not extract, reproduce, distribute, or modify exclusive premium mask resources for use outside the App. Premium mask resources are protected by intellectual property laws, and your license to use them is limited to personal, non-commercial use within the App.
Violation of these usage restrictions may result in immediate termination of your Premium Services access (without refund), suspension or termination of access to the free version of the App, and potential legal action if such violations infringe on our intellectual property rights or cause harm to us or third parties. Termination due to violation will not involve collecting, transmitting, or disclosing any of your local data, including facial information, as we have no access to such data at any time.
Our data practices for Premium Services are fully consistent with the MaskAI Privacy Policy, and we maintain the same strict standards of local data processing and non-collection of user data. Protecting your facial information, biometric data, and personal privacy is our top priority, and we adhere to an unwavering "zero-collection" principle for all such data. Key points specific to Premium Services include:
No data collection: All premium-related data—including access to exclusive masks, customization settings (transparency, edge blending, color tuning), batch processing history, high-resolution exports, and temporary preview files—is processed and stored exclusively on your local device. We do not collect, transmit, store, analyze, or retain any of this data on external servers, cloud storage, or our own systems. No information about your Premium Services usage, facial features, biometric data, personal data, image metadata, or processing habits is shared with us, third-party service providers, or any other entities. Facial key point recognition is performed solely on your device in real time, and the recognition results (coordinates, contours, etc.) are used only for immediate effect optimization—they are never stored, saved, or transmitted anywhere, and are permanently discarded as soon as the processing is completed.
Local storage control: Premium customization settings, categorized custom masks, batch processing history, and saved high-resolution images are stored in the App’s local cache or your device’s designated storage folder, under your full, exclusive control. You can delete this data at any time using the App’s built-in tools (e.g., clear cache, delete history), and uninstalling the App will permanently remove all Premium Services-related temporary data, customization settings, and locally processed facial feature data from your device. We have no ability to access, retrieve, restore, or manage any data stored locally on your device, even if you encounter technical issues or request support.
Security of premium data: We implement enhanced local security measures for Premium Services, including isolated storage of premium mask resources, encrypted local cache (where supported by your device’s OS), secure in-memory processing of facial key points (to prevent data leakage during computation), and no background data access. These measures are designed to protect your locally stored data from unauthorized access on your device. You remain responsible for securing your device to protect all App and Premium Services data, including any locally stored images containing facial information—this includes setting strong device passwords, enabling biometric locks (if desired), avoiding sharing your device, and keeping your device’s operating system and security software up to date.
We will never sell, rent, lease, disclose, or otherwise monetize any of your data—including Premium Services usage data, facial information, biometric data, personal privacy data, or locally processed content—to third parties, advertisers, or data brokers. Since we do not collect any data in the first place, there is no information to share, transfer, or profit from under any circumstances. This commitment applies to all present and future versions of Premium Services, and will not be altered by any feature updates or policy changes.
We may modify, update, or discontinue Premium Services (or any feature thereof) at any time, provided that we notify you of significant changes at least 30 days in advance via in-app notification. If we discontinue Premium Services entirely, we will provide a pro-rata refund for any unused portion of your subscription. Minor feature adjustments, bug fixes, or performance optimizations that do not reduce the overall value of Premium Services may be implemented without advance notice. Any modifications will not alter our core commitment to non-collection of facial information and personal privacy data—all updates will maintain strict local data processing, with no new data collection features or transmission capabilities added.
We may also update subscription plans, pricing, or included features for new subscriptions from time to time. Such changes will not affect active subscriptions until the next renewal period, and you will be notified of the updated plans or pricing via in-app notification before your renewal date. If you do not agree to the updated plans or pricing, you may cancel your subscription before the renewal date to avoid being charged for the new rate. No data about your reaction to plan changes (e.g., cancellation due to price increase) will be collected by us.
We may terminate your Premium Services access at any time, without refund, if you violate this Agreement, the MaskAI User Agreement, or the Privacy Policy. Examples of violations include unauthorized commercial use, infringement of intellectual property rights, uploading inappropriate content, using modified versions of the App, sharing subscription access with third parties, or engaging in fraudulent activity related to payment or usage.
You may terminate your subscription by canceling auto-renewal through your device’s app store settings or the App’s subscription management section. Upon termination (whether voluntary or involuntary), you will lose access to all Premium Services features at the end of your current billing period. The sections regarding intellectual property rights, disclaimers, limitation of liability, refund policy, and general provisions shall survive termination of this Agreement. Critically, termination will not result in the collection, transmission, or disclosure of any of your remaining local data, including facial information, biometric data, personal data, or locally processed content. We will not access or retrieve any data from your device upon termination, and all your local data will remain under your control.
Premium Services are provided "as is" and "as available" without any warranties of any kind. We disclaim all implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that Premium Services will be error-free, uninterrupted, compatible with all device models, or that premium features will produce results that meet your expectations in all cases. The quality of mask try-on effects remains subject to factors such as image clarity, lighting, facial angles, and device performance. We do not warrant or guarantee the security of your locally stored data (including facial information) against device theft, hacking, unauthorized access by third parties, or data loss due to device malfunctions—this is solely your responsibility, as we have no control over your device or the data stored thereon. We also do not warrant that the non-collection privacy mechanisms will be immune to tampering by modified app versions or third-party tools, as such actions are beyond our control and violate this Agreement.
In no event shall we be liable for any damages arising out of or in connection with your use of Premium Services, including but not limited to direct, indirect, incidental, or consequential damages (such as loss of data, device malfunctions, or losses arising from reliance on mask try-on effects). Our total liability to you for any claims related to Premium Services shall not exceed the total amount you paid for the subscription in the 12 months preceding the claim.
We shall not be liable for any issues caused by app store payment processes, third-party sharing services, device malfunctions, operating system updates, user error, factors beyond our reasonable control, or your failure to secure your device. We are also not liable for disputes arising from your use of user-generated content or custom mask images, including infringement claims related to content you upload or facial information of others contained therein. Since we do not collect any facial or personal data, we shall not be liable for any damages or disputes arising from the collection, use, or disclosure of such data by third parties, due to your own mishandling of local data, or as a result of device security breaches.
This Agreement, together with the MaskAI User Agreement and Privacy Policy, constitutes the entire agreement between you and us regarding Premium Services, superseding all prior or contemporaneous agreements, understandings, or communications (whether oral or written). All three documents emphasize our unwavering commitment to non-collection of facial information and personal privacy data, and any inconsistency between them shall be resolved in a manner that prioritizes your privacy protection.
We may modify this Agreement at any time. When we make changes, we will revise the "Last Updated" date at the bottom of this Agreement and notify you via in-app pop-up notification the next time you use the App. Your continued use of Premium Services after the updated Agreement is posted constitutes your acceptance of the modified terms. If you do not agree to the changes, you may cancel your subscription before the next renewal period. No modifications will weaken our core commitment to non-collection of facial information and personal privacy data—any updates to privacy-related terms will only serve to strengthen these protections.
